Trademark Application Platform Terms & Conditions

This Trademark Application Platform Terms & Conditions explains how Seaionl Inc. ("CertPing," "we," "our," or "us") collects, uses, stores, and discloses your personal information when you access or use our trademark platform (the "Service"). It also describes your privacy rights and the protections provided under applicable law.

We collect and process personal data only as necessary to operate, deliver, and improve the Service, including facilitating your trademark application, supporting communications with your selected attorney, and providing platform monitoring and dashboard access.

By using the Service, you acknowledge and consent to the collection and use of your information in accordance with this Privacy Policy.

Interpretation and Definitions

Interpretation

Words with initial capitalization have the meanings defined below. The definitions apply whether they appear in singular or plural.

Definitions

For the purposes of these Terms & Conditions:

  • Application means the CertPing platform, whether accessed via website or web application.
  • Attorney means Brian D. Owens, licensed in Texas, of Goodhue, Coleman & Owens, P.C., or any legal professional selected by you through the platform.
  • Company / We / Us / Our means Seaionl Inc., 8 THE GRN STE B, Dover, DE 19901, USA.
  • Customer / You means the individual or entity using the Service.
  • Platform Services means CertPing's non-legal services, including access to the trademark form, submission to Attorney, monitoring, dashboard access, and platform support.
  • Service means the CertPing Trademark Platform operated by Seaionl Inc.
  • Website refers to CertPing, accessible from https://certping.com/

Acknowledgment

These Terms & Conditions govern your use of CertPing. By using the Service, you agree to be bound by them. If you disagree, you must not use the Service. You confirm you are at least 18 years of age and legally capable of entering into binding contracts. Your access to the Service is also conditioned on acceptance of our Privacy Policy (available at https://certping.com/privacy-policy).

Platform Services

CertPing provides non-legal platform services for a platform fee of $200, including:

  • Trademark USPTO Form – Online application form to capture required information.
  • Submission to Attorney – Forwarding your completed form to the Attorney for USPTO filing.
  • Trademark Monitoring – Five (5) years of monitoring for potential conflicts or infringements.
  • Dashboard Access – A customer dashboard showing status updates.
  • Platform Support – Technical and process-related assistance.

No Legal Advice or Representation

CertPing is not a law firm and provides no legal advice, opinion, or representation. The attorney–client relationship exists solely between you and the Attorney. CertPing is not responsible for legal outcomes, responses to Office Actions, or any matter requiring legal expertise. All legal risk remains between you and the Attorney.

Fees & Payments

  • Platform Fee: A non-refundable platform fee is charged once processing of the application begins.
  • Attorney Fee: CertPing collects the attorney fee solely in an administrative capacity on behalf of the selected attorney. The fee is remitted in full to the attorney, who will be responsible for providing the agreed-upon legal services. CertPing does not set, negotiate, or guarantee attorney fees.
  • USPTO Filing Fee: The official USPTO filing fee, assessed per class, is collected by CertPing on behalf of the Attorney. The Attorney then submits the fee to the USPTO at the time of filing.
  • Additional Legal Services: Any services beyond the initial trademark application filing_including but not limited to Office Actions, oppositions, cancellations, appeals, enforcement, etc._constitute separate legal services. Such services are billed directly by the attorney and are not included in the initial fee arrangement.

Refund & Cancellation

Platform fees are non-refundable after application submission. USPTO and Attorney fees are non-refundable once transferred. CertPing is not liable for USPTO rejections, withdrawals, or customer-caused delays.

Customer Obligations

You agree that:

  • All information provided is accurate, complete, and truthful.
  • You are legally eligible to file for a U.S. trademark.
  • You will not use the Service for fraudulent, unlawful, or misleading purposes.
  • You acknowledge that all official communications related to your application and platform services will only be sent from and should only be received from the following domains:
  • @goodhue.com (Attorney communications)
  • @seaionl.com (Company communications)
  • @certping.com (Platform communications)

Data Privacy & Confidentiality

CertPing collects only the data required to process your application. Data is securely transmitted to the Attorney by preserving Attorney – Client privilege and not used for unrelated purposes. Confidentiality is maintained to the fullest extent permitted by law.

Trademark Monitoring Disclaimer

Monitoring is provided on a best-effort basis. CertPing cannot guarantee detection of all conflicts or infringements.

Limitation of Liability

CertPing shall not be liable for indirect, incidental, or consequential damages, including loss of profits, USPTO delays, or legal outcomes.

Indemnification

You agree to indemnify and hold harmless Seaionl Inc., CertPing, its officers, affiliates, and employees from claims or disputes arising from:

  • Your use of the Service.
  • Your trademark application.
  • Services rendered by the Attorney.

Termination

CertPing may suspend or terminate access to the Service without notice if you breach these Terms. Upon termination, your right to use the Service ceases immediately.

Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

Severability & Waiver

If any provision is found unenforceable, the remainder of the Terms remain valid. Failure to enforce a right does not waive future enforcement of that right.

Changes to Terms

CertPing reserves the right to update or replace these Terms. If material changes occur, we will notify customers by email or platform notice at least 30 days prior.
